ICE Endex operates the leading energy and environmental derivatives markets in Europe, as well as the natural gas balancing markets (spot) in the Netherlands and the UK. ICE Endex works with regulators and policy makers around the world to ensure effective supervision, regulatory compliance and reliable operation of markets. ICE Endex has self-regulatory responsibilities and maintains its own set of Market Rules.
Derivatives Markets
ICE Endex is authorised to operate a Regulated Market under the Dutch Act on Financial Supervision (AFS), implementing the requirements of MiFID II (Directive 2014/65/EU). ICE Endex is supervised in that capacity by the Netherlands Authority for the Financial Markets (AFM) as the competent authority under MiFID II.
As a trading venue on which wholesale energy products (natural gas and power derivatives) are traded, ICE Endex also operates as an Organised Market Place (OMP) within the meaning of REMIT II (Regulation (EU) 2024/1106). In that capacity, ICE Endex is subject to the supervision by the Netherlands Authority for Consumers and Markets (ACM) as the Dutch National Regulatory Authority (NRA) under REMIT, and at EU level by the Agency for the Cooperation of Energy Regulators (ACER).
Spot Energy Markets
ICE Endex's Dutch TTF natural gas spot contracts are wholesale energy products within the scope of REMIT II. Trading in these products on ICE Endex is subject to REMIT II market integrity requirements. Supervision is exercised by ACM as the Dutch NRA and by ACER at EU level.
ICE Endex also operates a market for UK natural gas spot contracts (OCM). These OCM contracts are subject to UK REMIT (Regulation (EU) No 1227/2011, as retained in the laws of the United Kingdom (UK) and amended by the Wholesale Energy Market Integrity and Transparency (EU Exit) Regulations 2019) and supervised by the Gas and Electricity Markets Authority (Ofgem) as the UK NRA.
Other Jurisdictions
ICE Endex permits access to its markets for participants that are located in jurisdictions for which ICE Endex has obtained authorization or confirmatory legal advice. This does not imply that ICE Endex operates regulated markets in each such jurisdiction. A list of these jurisdictions can be found here.
Dispute Resolution
Any disputes shall be exclusively resolved in accordance with the relevant Dispute Resolution and Arbitration provisions, set forth in these excerpts of the relevant Market Rules.
